Current Event News: Regulation of Supplements By El Richard, President of NOW® Foods From time to time, stories appear in the media that dietary supplements are unsafe and that the FDA lacks the power to protect the public. Most in the natural supplement industry know that this is not correct, but we want consumers everywhere to know this is far from the truth. Dennis Gronek, one of the leading attorneys on FDA matters has this to say about the present safeguards in the FDA regulations. “The Federal Food, Drug and Cosmetic Act (“FDC Act”) provides the FDA with more than ample powers to assure that dietary supplements are safe and properly manufactured and that claims made for such products are truthful, accurate and not misleading. The passage of DSHEA did not eliminate or weaken this legal authority.” Under the adulteration provisions of the FDC Act, the FDA may institute seizure actions, injunction proceedings or criminal cases against any person or company that manufactures or distributes a dietary supplement that: bears or contains any poisonous or deleterious substance which may render it injurious to health; has been subjected to economic adulteration; is a dietary supplement or contains a dietary ingredient that presents a significant or unreasonable risk of illness or injury; is a dietary supplement which there is inadequate information to provide reasonable assurance that such ingredients does not present a significant or unreasonable risk of illness or injury; is a dietary supplement or dietary ingredient with the FDA declares poses a imminent hazard to public health or Safety. (Sections 301 and 402 of the FDC Act). “Any claim that a product is intended to be used in the diagnosis, cure, mitigation, treatment or prevention of disease continues to convert such product into a ‘drug’ under the Act. Drugs that are not generally recognized as safe and effective by qualified experts for their intended use are ‘new drugs’ and must be approved by the FDA before their introduction into the marketplace… Under the misbranding provisions of the FDC Act any claim in food or dietary supplement labeling that is false or misleading in any particular will render such product misbranded and in violation of the Act (Section 403). Also, pursuant to Section 403 r(6) of the FDC Act all Structure/function calims must be supported by adequate substantiation to establish that such claims are not false or misleading…… When a violation of the FDA Act is found to exist, the FDA may seize and destroy violative goods, obtain a court order to prevent their current and future sale, or initiate criminal proceedings. Successfully prosecuted criminals face jail.” · DSHEA - The Dietary Supplement Health & Education Act passed in 1994. · FDC Act - The Food, Drug & Cosmetic Act was in existence prior to 1994 and still is in effect. · FDA - The Food and Drug Administration has the responsibility to enforce DSHEA and the FDC Act.

Chromium Picolinate Gets Official Health Claim Stamp by the FDA
By Greg Arnold, DC, CSCS, August 31, 2005
In August 2003 the US Food and Drug Administration, acknowledged that “consumers will benefit from more information on food labels concerning diet and health” and decided to permit "qualified" health claims for both dietary supplements and conventional foods.(1)
On September 8, 2004, the Food and Drug Administration officially put such a qualified health claim on omega-3 fatty acids, concluding that “supportive but not conclusive research shows that consumption of EPA and DHA omega-3 fatty acids may reduce the risk of coronary heart disease”.(2)
This came after years of research showing that omega-3 fatty acids help fight the inflammation that leads to heart disease,(3) stroke,(4) and atherosclerosis.(5) But it wasn’t until the Institute of Medicine found that "Growing evidence suggests that dietary omega-3 fatty acids reduce the risk of coronary heart disease and stroke"(6) that the FDA finally put the health claim on
omega-3 fatty acids.
Now the FDA has added a qualified health claim to another supplement, chromium picolinate, nearly 2 years after a petition was first submitted(7) requesting that a health claim apply to the supplement.
According to a 2005 study,(8) the savings chromium picolinate could provide the health care industry could be substantial. According to the researchers, the average 3-year cost savings could range from $1,636 to $5,435 per patient, leading to an overall 3-year cost savings between $3.9 billion and $52.9 billion for the 16.3 million existing patients with diabetes.
Although they announced that “chromium picolinate may reduce the risk of insulin resistance, and therefore possibly may reduce the risk of type 2 diabetes ”, the FDA still remains very cautious of this health claim, stating that “the existence of such a relationship between chromium picolinate and either insulin resistance or type 2 diabetes is highly uncertain.”
When it comes to the proper dosage for chromium picolinate, Dr. Richard Anderson, a biochemist and nutritionist with the Department of Agriculture, recommends 400-600 mcg daily as sufficient to help control blood sugar.(9)

Thyroid, Master and Commander
By Jayson Kroner, C.S.N. NOW Marketing Department, September 20, 2005
Fact: Millions of Americans trying to lose weight are horrified to see their bathroom scales inching uncontrollably up-wards. And these numbers increase every single year. Making matters worse, many of these same people are shocked to find their energy levels slipping inexorably downwards.
“I guess I’ve just got a slow metabolism…”
“You can’t get as much done when you start getting older…”
“Why am I always so cold?”
Sound a little too familiar? What if there was a safe and natural way to energize your metabolism and keep it operating at its youthful, maximum efficiency? While it is true that metabolism slows somewhat with age, its not inevitable that every one of us is destined to end up with more weight to move around and less energy to get there. There are people in their 30’s, 40’s, 50’s, 60’s and beyond with all the vibrant energy they need. There are people who end every day with a list of important accomplishments completed. So what’s their secret? It may well be a healthy, fully functioning thyroid.
The human thyroid is a butterfly-shaped gland located in the front of the neck that wraps around the trachea. One of its primary responsibilities is to produce the two critical thyroid hormones we need to keep our metabolism efficient.(1) In fact, these hormones are indispensable for our bodies to convert calories into energy – and that’s the crux of metabolism. These two hormones, triiodothyronine and thyroxine, or T3 and T4 respectively, are produced in the thyroid when the iodine in our system teams up with the amino acid L-tyrosine .(2)
Sounds simple, right? Think again. Human metabolism is a highly intricate process that can be adversely affected by a wealth of variables. One important variable that we can control, is the nutrient mix our thyroid keeps on hand to operate. In order for metabolism to occur with any respectable level of effectiveness, the body must have a full supply of thyroid supporting nutrients on hand at all times. If you aren’t willing to deliver the nutrients it needs to function properly, chances are, it won’t be willing to keep your metabolism fired up and your energy resources fully charged.
Don’t despair. There is good news. Encouraging and maintaining healthy thyroid function may be easier than you might imagine. This master gland of metabolism is often very responsive to the right combination of thyroid supporting nutrients.(3) Yes, a healthy diet can promote a healthy thyroid, but some of the nutrients that are especially helpful in supporting healthy thyroid function are not likely to be found in your local market. That is, unless you happen to be shopping in India or Ireland. The following are some of the best nutrients for supporting a healthy, energized thyroid.
L-Tyrosine
This amino acid plays an essential role in the production of thyroid hormones, in addition to hormones that affect mood including epinephrine, norepinephrine, serotonin, and dopamine.4 And while our body can naturally produce some Tyrosine from other amino acids, as we age, our bodies may not be able to keep up with the needs of a demanding thyroid. During metabolism, tyrosine joins forces with iodine in order to produce the thyroid hormones needed to efficiently convert (metabolize) the calories from our diet into expendable energy.(5) A weak reserve of tyrosine can leave us feeling sluggish. As a result, our body reacts by storing more calories as fat for energy.
Iodine
Another key player in the metabolism game. Without it, metabolism simply can not take place. The thyroid is the only gland in the human body capable of absorbing this trace element. Typically found in shellfish and iodized salts, iodine is stored in the thyroid gland until needed for the production of the thyroid hormones triiodothyronine and thyroxine. When combined with L-tyrosine and other nutrients these two work synergistically to produce T3 and T4 thyroid hormone. Moreover, iodine deficiencies have been linked to the formation of goiters, decreased energy and the lack of concentration.(6)
Irish Moss
A natural vegetarian source of many thyroid-supporting nutrients, including Iodine, a key component in healthy metabolism. Irish moss has been consumed for thousands of years, and many herbalists encourage its use to contribute to sound glandular health.
Selenium This naturally occurring trace mineral is well known for its strong antioxidant properties and natural synergism with other vitamins.(7) Supplementing with selenium is essential for anyone concerned with sluggish thyroid performance.
Guggul
Technically known as Guggulsterone, the Guggul tree is native to India, and emits a resinous sap that has been used for centuries as part of India’s traditional medicine known as Ayurveda. Studies have shown that the purified plant sterol extract from Guggulsterone can promote healthy thyroid function, and assist the body in maintaining normal production of thyroxine and triiodothyronine.(8)
Simply put, the thyroid gland relies heavily on a host supporting nutrients to produce the hormones needed to ensure that metabolism goes off without a hitch. Without these vital nutrients, our ability to metabolize food may slow down. Thyroid Energy™ from NOW delivers all of these nutrients in one, easy to take formula.

Pomegranate: The Anti-Arthritis Fruit
By Greg Arnold, DC, CSCS, September 12, 2005, abstracted from “Punica granatum L. Extract Inhibits IL-1(beta)-Induced Expression of Matrix Metalloproteinases by Inhibiting the Activation of MAP Kinases and NF-(kappa)B in Human Chondrocytes In Vitro”
As the nation’s leading cause of disability, arthritis limits everyday activities for 16 million Americans, results in 750,000 hospitalizations and costs our healthcare system over $51 billion each year.(1) Of the different types of arthritis (osteoarthritis, rheumatoid arthritis, gout), the most common type is osteoarthritis, which currently affects 21 million Americans.(2)
When looking at options for preventing and treating arthritis, Glucosamine and Chondroitin sulfate help both prevent and treat OA(3) primarily through their ability to reduce inflammation, stimulate the synthesis of proteoglycans and hyaluronic acid, and reduce the synthesis of nitric oxide and cell death of cartilage cells.(4,5,6)
Now a new study(7) has found another natural treatment for OA, this time from a fruit increasing in popularity because of its high antioxidant content: pomegranate juice .
Already known to help prevent heart disease,(8) the pomegranate is native to the area between Iran and northern India, and has been cultivated since ancient times throughout the Mediterranean basin to India. The plant is used to make juice, dyes, inks, tannins for leather (bark) and a variety of remedies for various ailments.(9)
In the study, researchers treated samples of knee cartilage with Pomegranate juice extract (PFE) given in 6.25–25 mg per liter. They found that the PFE stopped the activity of an inflammatory protein called Interleukin-1b that is responsible for the cartilage breakdown that is the hallmark of OA.(10)
According to the researchers, “PFE…may inhibit cartilage degradation in OA and may also be a useful nutritive supplement for maintaining joint integrity and function.”

Get Relief from Seasonal Allergies Without Drowsiness Using Herbal Butterbur Extract
By Susan Sweeny Johnson, PhD. Biochem., Sept. 22, 2005, abstracted from Schapowal et al., “Treating Intermittent Allergic Rhinitis: A Prospective, Randomized, Placebo and Antihistamine-controlled Study of Butterbur Extract Ze 339”, Phytotherapy Research 19:530-537 (2007), online at Wiley InterScience
Antihistamine treatments for intermittent allergic rhinitis, commonly know as seasonal allergies or ‘hay fever’, are generally effective in reducing symptoms of runny nose, congestion, sneezing, and itching eyes and nose but they often cause drowsiness which interferes with normal activity.
In this study, Butterbur standardized extract reduced hay fever symptoms as well as fexofenadine, a common antihistamine, without producing drowsiness.
Three hundred and thirty patients with moderate to severe hay fever symptoms were enrolled in a double-blind, randomized study over two weeks. This carefully controlled study was designed using standardized guidelines for assessing response to antihistamines.(1) One group received 180 mg of fexofenadine (Telefast 180), one group received 8mg of petasine (Butterbur extract Ze339) three times daily and one group received a placebo.
The symptom improvement score was based on an average of patient self-response and physician evaluation. Both the Butterbur group’s and the antihistamine group’s symptoms improved significantly and to a similar extent when compared to the placebo group. For example, physician evaluation scores at the end of the two week study showed 76 +/- 1.3% of patients improved moderately or better on fenoxidine, 70 +/- 1.4% on Butterbur extract and 32 +/- 1.5% on the placebo. No adverse reactions occurred within the Butterbur group including no significant change in liver enzymes.
It should be noted that Butterbur (Petasites hybridus) should be used as an extract since potentially harmful alkaloids naturally occur in the plant.
Extensive research has been published on the effective use of Butterbur extract for treatment of seasonal allergies supporting the results of this study.(2,3,4,5,6)

Lycopene: The Anti-Cancer Carotenoid?
By Greg Arnold, DC, CSCS, September 12, 2005, abstracted from “Lycopene Inhibits Cell Migration and Invasion and Upregulates Nm23-H1 in a Highly Invasive Hepatocarcinoma, SK-Hep-1 Cells” in the September 2005 issue of the Journal of Nutrition
As the new number one killer of Americans,(1) the U.S. bill for direct medical costs and lost worker productivity due to cancer totals nearly $190 billion. Numbers like this have prompted experts to emphasize that “The best possible way to deal with cancer is not to have it in the first place, so the focus on prevention makes great sense”.(2)
While exercise(3) and improved mental well-being(4) are effective in cancer prevention, fruit and vegetable consumption may be the most powerful form of prevention against cancer. A 2004 study(5) found that “greater intake of fruits and vegetables was associated with lower risk of all-cause, cancer, and cardiovascular disease death”. The study supports the general health recommendation to consume at least five to nine servings of fruits and vegetables per day.
When looking at why fruit and vegetables are so powerful in helping prevent cancer, we need to look no further than carotenoids, the antioxidants abundant in fruits and vegetables that give them their color. There are currently more than 700 different types of carotenoids .(6)
Although beet-carotene is the most heavily studied carotenoid, research is finding lycopene , the carotenoid that gives tomatoes their red color, to be a very potent carotenoid. Now a new study(7) continues to shed more light on lycopene’s anti-cancer properties.
In the study, researchers sought to find out whether lycopene could inhibit cancer by increasing the activity of nm23-H1, a gene known to prevent the spread of cancer. They were able to show that “lycopene was much more effective than beta-carotene ” in helping reduce the spread of breast cancer by an astounding 870% while increasing the activity of nm23-H1 by as much as 250%.
These results caused the researchers to conclude that lycopene has “significant” anti-cancer properties due to its ability to increase the expression of anti-cancer genes, especially nm23-H1.
